Buying from a licensed motor dealer – Your Rights

Buying from a licensed motor dealer is the safest way to buy a used car.
Motor dealer licences
As per regulations Tru-Blue Motors has a licence to sell:
- used cars
- other used vehicles.
When you buy a used car from Tru-Blue Motors, you are entitled to:
- a statutory warranty (in some circumstances)
- a cooling-off period
- a guarantee of clear title on the vehicle
- access a claim fund, which may compensate you if you suffer financial loss because of the motor dealer’s actions.

Statutory warranty
In certain circumstances, you are entitled to a warranty at no extra cost when you buy a second-hand vehicle from:
- a licensed motor dealer
- a licensed chattel auctioneer.
We call this a statutory warranty. It protects you from financial loss if your vehicle is faulty.
Cooling-off period for buying a used car
When you buy a used car from a licensed motor dealer, you’re entitled to a cooling-off period of 1 business day. You can cancel the contract during the cooling-off period without large penalties.
Clear title or free from debt
‘Clear title’ means something that is free from unpaid debt. If a person has a car loan, the company that lent them the money has an ‘interest’ in the car. The car does not have ‘clear title’, because the person does not fully own it. If you buy a car without clear title, and the previous owner defaults on their debt, the lender may repossess your car to recover their costs. Never purchase a vehicle that does not have clear title.
If you buy a vehicle from a licensed motor dealer or auctioneer, they must guarantee clear title.
You can ask for proof in the form of a Personal Property Securities Register(PPSR) certificate. The dealer can charge you a small fee for this.
